2 1-1B Litigation3 Comparative Aanalysis of Cross-Border Disputes and Access to Justice The session will examine key differences in how disputes are adjudicated in litigation (particularly Korean courts) v. international arbitration, using real cases. In addition to reviewing procedural differences, the key issue to be discussed is how civil law judges and common law arbitrators may have different perspectives on contractual disputes, and whether certain types of disputes – in terms of substantive issues or remedies sought - are more suited for litigation or arbitration. 3 1-1C Career The Braiding of South Korean and U.S Legal Education and Legal Professional This session explores how legal education and professional development in South Korea and the United States have shaped—and continue to shape—each other. It begins with insights on the impact of South Korea’s 2007 legal education reform, modeled after the U.S. system, on the career trajectories of Korean lawyers. Dean Hwang Lee will share a law school dean’s perspective on the reform’s influence on legal training and career choices, while Professor JaeWon Kim will discuss its cultural implications on traditional Korean values. Professor Summer Kim and Grace Lee will present early findings from UC Irvine Korea Law Center’s Korean Lawyers in America Project (KLAP), a longitudinal study tracking the careers of U.S.-educated legal professionals of Korean descent. 20 2-1D Pro bono Title: International Adoption and the Rights of Adoptees: Past, Present and Future International adoption has seen many changes over the years. Lawsuits have been filed against the state and an adoption agency for human rights violations during the adoption process to the U.S., and the Truth and Reconciliation Commission has found the state liable for the grievances of hundreds of international adoptees. Additional lawsuits seek information about deceased adoptive parents, with a related Constitutional Court case pending, and a movement is underway in the U.S. to change the law to provide relief for adoptees without citizenship.This session will examine these national and international developments and explore the challenges and solutions ahead.
